Terms of Service

1. Acceptance of Terms

By accessing or using the NetVigil service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

NetVigil is a service provided by a Canadian company based in Nova Scotia, Canada.

2. Description of Service

NetVigil provides an external attack surface management platform that helps organizations discover, assess, and monitor their internet-facing digital assets. The Service includes:

• Domain and IP address monitoring
• DNS verification and resolution tracking
• Port scanning and endpoint discovery
• Web technology fingerprinting and version detection
• Vulnerability identification and CVE reconciliation
• Email alerting for security findings
• Security reporting and dashboard analytics

3. Account Registration

To use the Service, you must register for an account and provide accurate, complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

You must be at least 18 years old to create an account. By creating an account, you represent that you have the authority to bind your organization to these Terms.

4. Subscription Plans and Billing

NetVigil offers both free and paid subscription plans. Paid plans are billed on a recurring monthly or annual basis through our payment processor.

Plan Tiers

• Free Plan: Up to 5 assets, weekly automated scans. No credit card required.
• Pro Plan: Up to 25 assets, daily automated scans. Billed monthly or annually.

Payment Terms

• Payment is processed at the beginning of each billing period.
• All prices are listed in CAD. Applicable taxes may apply.
• Annual subscriptions are billed as a single upfront payment.
• We reserve the right to change pricing with 30 days' notice. Existing subscribers will be grandfathered at their current rate until the end of their current billing period.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must only scan assets that you own or have explicit authorization to monitor. You agree not to:

• Use the Service to scan or probe systems you do not own or have authorization to test
• Use the Service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to any systems or networks
• Use the Service to violate any applicable local, provincial, national, or international law
• Resell or redistribute access to the Service without permission
• Interfere with or disrupt the Service or servers connected to the Service

6. Intellectual Property

The Service and its original content, features, and functionality are owned by NetVigil and are protected by international copyright, trademark, and other intellectual property laws.

Your scan data and reports remain your property. We do not claim ownership of any data you provide or that is generated through your use of the Service.

7. Service Availability

We strive to provide reliable and uninterrupted service but cannot guarantee that the Service will be available at all times. We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice.

We may perform scheduled maintenance, during which the Service may be temporarily unavailable. We will make reasonable efforts to notify users of scheduled maintenance.

8. Limitation of Liability

NetVigil provides security monitoring tools to help you identify potential vulnerabilities, but no security tool can guarantee complete protection. The Service is provided "as is" without warranties of any kind, either express or implied.

To the fullest extent permitted by law, NetVigil shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising from your use of the Service.

You are solely responsible for acting on the information and findings provided by the Service. NetVigil does not provide remediation services and is not responsible for any security incidents that may occur.

9. Termination

You may terminate your account at any time through your account settings or by contacting us. Upon termination:

• Your right to use the Service will immediately cease.
• We will delete your account information within 30 days, as described in our Privacy Policy.
• If you have an active paid subscription, cancellation will take effect at the end of the current billing period. No partial refunds are provided for the remaining period. See our Refund Policy for details.

We reserve the right to suspend or terminate your account if you violate these Terms, with or without notice.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Nova Scotia and the applicable federal laws of Canada, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of Nova Scotia, Canada.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by email or through the Service at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
